What the form is for
A non-lucrative residence authorisation (autorización de residencia temporal no lucrativa) lets you and your family live in Spain without doing any work or professional activity. You ask for it from your country of origin.
You apply in person at the Spanish consulate (Oficina Consular) for the area where you live, or at an external service provider or another embassy or consulate designated by Spain's Foreign Affairs ministry. You apply for a residence visa, and that application includes the request for the authorisation. You hand in the EX-01 with your documents and pay the fee with form 790 code 052. The consulate also charges a visa fee; check your consulate's page on exteriores.gob.es.
The form also has a box for renewals ("RENOVACIÓN"). This guide covers only the first application. The ministry says its information sheets are guidance only: the rules in force on the day you apply are the ones that count.
Who needs it
The ministry's information sheet no. 6 (Hoja informativa 6, last updated May 2025) and Real Decreto 1155/2024 set these conditions for the first application:
- You must not be in Spain irregularly.
- With this authorisation you may not work or run a business in Spain.
- You must not be a citizen of an EU or EEA state or of Switzerland, or a family member of one who falls under the EU citizen regime.
- You must not be listed as someone to be refused entry ("rechazable") in the countries with which Spain has an agreement on this.
- You must not be within a no-return period that you accepted when you returned voluntarily to your country of origin.
- You must not be a threat to public order, public security or public health.
- You need enough money to live in Spain without working: every month 400% of the IPREM for you, plus 100% of the IPREM for each family member. The IPREM is a public reference income index that Spain sets each year; use its monthly value. The total must cover the period of the authorisation. Check the current IPREM value before you prepare your proof.
- You need public or private health insurance with a company authorised to operate in Spain.
- You need a clean criminal record in Spain and in the countries where you lived in the last five years, for offences that also exist in Spanish law.
- You must not have a disease that could seriously affect public health under the International Health Regulations of 2005.
- Family members you can include: your spouse or registered or stable partner, your unmarried minor children (or those of your partner), and adult children with a disability or who cannot provide for themselves because of their health.
- The decision comes within one month of the consulate passing on your request. If there is no answer in that time, the request counts as refused.
- The first authorisation lasts one year from the day you enter Spain. If the visa is granted, collect it in person within one month of being notified and enter Spain while it is valid (never more than three months).
- The fee is paid with form 790 code 052 (item 2.1.1, initial non-lucrative residence), within ten working days of handing in the application. The consulate also charges a visa fee; check your consulate's page on exteriores.gob.es.
- Within one month of entering Spain you must ask in person for your foreigner identity card (TIE) at the police station for your place of residence.
Before you start
- The EX-01, filled in and signed by you. The form asks for the original and a copy.
- A complete copy of your passport or travel document, valid in Spain, with at least one year of validity left.
- Criminal record certificate from your country of origin and from every country where you lived in the five years before entering Spain.
- Proof of your money. Any evidence is accepted, including property deeds, certified cheques or credit cards with a bank certificate of the available credit. If your money comes from shares in companies based in Spain, you also need a certificate from the company that you do not work there, plus a sworn statement.
- Proof of your health insurance.
- A medical certificate.
- Proof that you paid the fee (form 790 code 052).
- Documents from other countries need a sworn translation into Spanish (or the co-official language where you apply) and legalisation or an apostille, unless exempt. In general you hand in copies and show the originals.
Section by section
The form is in German. Here is what each part asks, in plain words, in the order it appears.
Espacios para sellos de registro
The box at the top right is for the registration stamps of the office. Leave it empty.
1) Pasaporte, N.I.E., names
Passport number. Fill in the N.I.E. box only if you have one. Then your first surname (1er Apellido), second surname (2º Apellido) and first name (Nombre).
Sexo (1)
Tick one: H (hombre, man), M (mujer, woman) or X (indefinido). The form says X can only be ticked by people who have it recognised in their country of origin.
Fecha de nacimiento (2), Lugar, País, Nacionalidad
Date of birth as dd/mm/aaaa: 2 digits for the day, 2 for the month and 4 for the year. Then place and country of birth, and your nationality.
Estado civil (3)
S = soltero/a (single), C = casado/a (married), V = viudo/a (widowed), D = divorciado/a (divorced), Sp = separado/a (separated). Tick one.
Nombre del padre, Nombre de la madre
Your father's and mother's names.
Domicilio en España, Localidad, C.P., Provincia, teléfono, e-mail
Fill in the boxes that apply to you. Give a mobile phone and an e-mail: the form says they are used to send you an informative notice when a notification is waiting.
Representante legal, en su caso (4)
Only if you have a legal representative: their name, their DNI/NIE/passport number and the title of the representation, for example "Padre" or "Madre del menor", "Tutor". Otherwise leave the line empty.
Hijas/os a cargo en edad de escolarización en España
Tick SÍ or NO: whether you have children in your care who are of school age in Spain.
2) Datos del familiar titular de los recursos económicos (en su caso)
Only if you apply as a family member who relies on the money of another person, the one who holds the economic means. Fill in that person's passport or N.I.E., names, sex, civil status, date of birth, country, parents' names and "Parentesco" (relationship). If you hold the means yourself, leave the section empty.
3) Datos del representante a efectos de presentación (5)
Only if someone other than you hands in the application (for example an adviser). Otherwise leave the whole section empty.
4) Domicilio a efectos de notificaciones, and Dehú
Name, ID, address, phone and e-mail of the person who should receive the notifications. If you leave it empty, they go to the applicant. The box "CONSIENTO…" agrees to receive notifications electronically in the Dehú (Dirección electrónica habilitada Única); then you must have a valid digital certificate or Cl@ve to read them.
5) Tipo de autorización solicitada (7)
For this first application tick RESIDENCIA INICIAL, then one option: Titular de los recursos económicos (you hold the money) or Familiar del titular de los recursos económicos (you are a family member of the person who does). RENOVACIÓN is for renewing an existing non-lucrative authorisation and is not covered here: for a renewal, follow the ministry's renewal page on www.inclusion.gob.es (Hoja 7, "Renovación de la autorización de residencia temporal no lucrativa").
Place, date, signature, Dirigida a
Town and date ("…, a … de … de …") and the signature of the applicant (or of the representative). "DIRIGIDA A", "Código DIR3" and "PROVINCIA" name the office the application is addressed to; if you don't know the DIR3 code, ask that office.
Common mistakes
Ticking RENOVACIÓN for a first application
For your first application tick RESIDENCIA INICIAL. RENOVACIÓN is only for people who already hold the authorisation.
Mixing up the two options
"Titular" is the person who holds the economic means. "Familiar del titular" is a family member who relies on them: in that case fill in section 2 too.
Filling in section 3 for yourself
Section 3 is only for a person other than the applicant who hands in the application.
Ticking the Dehú box without a digital certificate
Electronic notifications are read with a digital certificate or Cl@ve. Without one, you may miss the answer.
Foreign documents without translation or legalisation
Documents from other countries need a sworn translation and legalisation or an apostille, unless exempt. Prepare them before you go to the consulate.
Bringing a single copy
The form says to hand in the original and a copy. Print it twice.
